By accessing or using Jewels Retouch ("the Service"), you agree to be bound by these Terms of Service. Jewels Retouch is operated by Serdar Arniyazov ("Operator", "we", "us", or "our"). If you do not agree to these terms, please do not use the Service.

2. Description of Service

Jewels Retouch is an AI-powered jewelry photo retouching service that transforms amateur jewelry photographs into professional product images. The Service includes:

• AI-powered image processing and enhancement
• Background removal and replacement
• Metal and stone color adjustment
• Style matching based on reference images
• Jewelry set and poster composition features

3. User Accounts

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Payment Terms

The Service operates on a pay-per-use model. Current pricing is $0.50 USD per image generation. Prices may be displayed in local currencies based on your location.

• Payments are processed securely through LemonSqueezy
• You must add a valid payment method before processing images
• Charges are applied immediately upon successful image generation
• All sales are final unless the Service fails to deliver the promised result

5. Refund Policy

We offer refunds in the following circumstances:

• Technical failure where no output image is generated
• Service downtime that prevents access to completed images
• Duplicate charges due to system errors

6. Acceptable Use

You agree not to use the Service to:

• Upload content that infringes on intellectual property rights
• Process images you do not have rights to use
• Create misleading or fraudulent product representations
• Attempt to reverse engineer or exploit the AI systems
• Upload illegal, harmful, or offensive content
• Overwhelm or disrupt the Service infrastructure

7. Intellectual Property

Your Content: You retain ownership of images you upload. By using the Service, you grant us a limited license to process your images for the purpose of providing the Service.

Output Images: You own the processed images generated from your original content. You may use these images for commercial purposes.

Our Service: The Jewels Retouch name, logo, AI models, and underlying technology remain our intellectual property.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. We process your images solely to provide the Service and do not use them for AI training without explicit consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

• The Service will meet all your requirements
• Results will be error-free or match exact expectations
• The Service will be uninterrupted or available at all times

10. Limitation of Liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 30 days preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We may also update these Terms of Service, with changes effective upon posting.

13. Termination

We may terminate or suspend your account at any time for violations of these terms. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through your account settings.

These terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation or, if necessary, through appropriate legal channels.
